In this assignment, you will get an opportunity to learn, from actual experiences, how an informed manager would assess the current overall health of an organization and make decisions regarding future opportunities and performance.

Tasks:

Select an industry relevant to your career. If you lack work experience, you can base your selection on real-life market situations or business areas that you may have knowledge about. You can also consult sources such as the Wall Street Journal,Financial Times, Bloomberg Markets, the Economist, US News and World Report, and the online library resources.

  • Research the growth opportunities in the industry, competitive strategies that were employed, typical customers, and other relevant information related to the industry. Specific opportunities will differ depending on the industry selected, but be sure to consider current economic events and news relating to the industry that may influence the future direction of your industry.
  • Within this industry, select a midrange-performing company that provides goods or services. Then, address the following:
    • Analyze why this company maintains the level of success it does from an economic and financial perspective. Develop at least two visual aids (e.g., charts, graphs, or tables) to support your argument.
    • Evaluate whether the company’s pricing and positioning decisions contribute to or hinder that success.
  • Evaluate whether the strategy currently used by your industry, as discussed in previous sections, appears to be sustainable over time.

 

Create a 3 to 5-page research paper. At the end your paper, include a reference page and cite scholarly sources in APA style.

American National Government

The Constitution states, “The House of Representatives shall be composed of Members chosen every second Year by the People of the several States…” (Art. I, Sec. 2). Contrast this with the original constitutional language for the other house of Congress, “The Senate of the United States shall be composed of two Senators from each State, chosen by the Legislature thereof for six Years…” (Art. I, Sec. 3). The phrase “chosen by the Legislature” was changed to “elected by the people” by the 17th Amendment, but not until 1912. In other words, from the beginning the House of Representatives was intended to be exactly what its name suggests –representative of the people. (Note that in 2010 the Tea Party, and some Republican politicians, called for repeal of the 17th Amendment, eliminating the popular vote for Senators. While most Republican politicians have backed away from that view, many Tea Party chapters continue to demand its repeal.)    

Textbook models suggest how members of the House of Representatives may fulfill their constitutional duty to “represent” – the delegate model, the trustee model, the oversight model, and the service model. A weakness of these models is that they ignore the pervasive influence of interest groups, partisanship, and political money (campaign contributions) on the behavior of congressional reps. To what extent do these factors interfere with effective representation?

After researching your representative by using the assigned resources, identify one important issue directly related to your rep’s committee or subcommittee work in Congress. Summarize your representative’s position on this focus issue as described on his or her website or illustrated by legislation sponsored by your rep.  Be concrete and specific.  Avoid vague generalities like “my representative is for jobs” or “my Congressman is for national security.”

With respect to this focus issue, evaluate your representative’s performance as a representative of the people in your legislative district. Justify your assessment from two perspectives:

  • How well does your rep’s position on that issue reflect your district’s likely preferences or broad interests on the issue? Support your inferences about the district with fact-based evidence – not just your opinion about the district or your rep’s position on the focus issue. Demonstrate how your rep does or does not reflect his or her constituency on this issue. Consider your rep’s committee memberships and seniority.
  • Discuss fact-based evidence about how interest groups, political party loyalty, or campaign money may influence your representative. Can these influences weaken his or her effectiveness as a true “representative” of the district? Consider whether the district is considered a “safe” seat or a competitive district. Put on your critical thinking cap to respond to this aspect of the question.

Miranda Warnings

Write a 3–4-page paper (excluding cover page and reference page) responding to the following:

Miranda warnings are a high point of contention in the law enforcement scene. There are many misunderstandings as to when “Miranda” applies. Watch the following video and discuss what you would do in this scenario.

You are a mentor/FTL to a new police officer on duty and it was his first arrest. He was called to a house break in, and saw a young boy outside of the house. He arrested him. He had no evidence but took him to the police station for questioning.

Once he arrived at the police station, he realized that the suspect does not speak English. He tried to question him and the boy replied in Mandarin. The new police officer knows that the law requires him to administer a warning and ask the suspect if they understand. It is clear that boy does not understand what is being said.

The new police officer is not absolutely sure that the boy was involved in the break in, but he was on the scene when the officer arrived. A family member arrived to see the boy and speaks English and asks the new officer what is happening. Both the boy and the family member do not know their rights. The case has been handed over to a follow-up investigator; you have been briefed on the facts, and are asked to sit down with the officer and discuss the issues at hand and how they relate to his performance.

In your paper, describe what you would say to the new officer. Identify at least four issues relating the Miranda law to this specific situation. Relate these issues to specific historical events from your Reading, Discussions, and research. Determine how you would resolve each of these issues, if they can be resolved through careful analysis of the situation. Explain what could have been done to prevent these issues from occurring.

Given research over the last several decades, one thing that is clear about learning is that people, including students, of course, who think they can improve their ability to learn achieve better grades and success in other areas of their lives. On the other hand, people who think their ability to learn is just something they are born with, that they can’t help, do less well.

Thinking — really believing — that you can improve your ability to learn has come to be known as a Growth Mindset, while thinking you are simply stuck with what you were born with is called a Fixed Mindset.

Richland College is currently engaged in a Quality Enhancement Plan (QEP), which doesn’t really matter to you except that you’ll run into it in some of your classes. The basis of the QEP is “Developing Learning Power,” and helping students develop Growth Mindsets is part of the program. Technically this Government 2305 class is not part of the QEP, but we will be doing a few things during the semester that are aimed at doing some of the same things the QEP is working on.

So, for this assignment, I would like for you to read through the attached brief slideshow, take the little quiz that’s in there, and write a brief reflection on what you read and did. You will not be graded on the quiz. It’s just a way for you to find out for yourself if you have more of a Growth or Fixed Mindset currently. Over the semester, as I said, we’ll do just a couple of things that may help build that Growth Mindset.

Your Reflection should be written, as with everything in this class, in MLA format, with Times New Roman font, 12 point, double-spaced, and an appropriate MLA heading. For this assignment there really won’t be a “Works Cited” page, so that won’t be a worry.

It should be a minimum of 250 words (that’s tiny!), and should be turned in by no later than 11:59 p.m. on April 18.

RESEARCH PAPER INSTRUCTIONS Presidential Leadership in Domestic/Budget Policy-Making

You must compose 6–8 pages that analyze presidential leadership. You must use current Turabian format with 1-inch margins and 12-point Times New Roman font. Include a title page and bibliography. 3)      Describe the example of presidential leadership precisely, including words and deeds.

                                                                                                                                                Salazar v. Buono

This case relates to the first amendment of the constitution which is the freedom of speech and freedom of religious. In the case Salazar v. Buono, which about a cross was erected as a memorial to fallen service members in a remote area within what is now a federal preserve. However, the court permanently enjoined the government from permitting the display of the cross, Congress enacted legislation directing the Department of the Interior to transfer an arche of land including the cross to the VFW in exchange for a parcel of equal value. In this case, Buono’s action was between both saying that Congress was acting against the first amendment by moving the cross, but when the Congress refers to the land swap, he prohibits it. His action and decision making the district court permanently enjoined the government from implementing that Act of Congress.
