Because sexual arousal is an emotional response, it is to be argued  that those who participate in sexual deviance, are responding to a  biological response their body is sending out (Smid, Wineke, Wever,  Edwin, Smid, & Wineke, 2018). However, this does not mean that the  response should be acted on and that the person should not be held  accountable for his or her actions, but I believe it does give hope  there could be some kind of potential medication that could help the  sufferer lessen, or eliminate, the unhealthy urges they are feeling. The  biological response of wanting to have sexual contact with children,  harm someone sexually, or any other sexually deviant thing that could be  potentially harmful, is something that must be addressed in order to  prevent these persons from becoming victims to the biological tendencies  their bodies are putting off, though I do not believe biology itself is  the only factor to blame for the reason these urges come about, which  is explained in the following paragraph about the ways psychological  matters can affect children into adulthood, and play a role into sexual  deviance.

Children who have been sexually abused have a higher likelihood of  becoming sexually deviant themselves when they grow older (Levenson  & Grady, 2016). These children are often times exposed to other  things like parents who are neglectful, drug addicts, incarcerated and  abusive in other ways, which may also lead them to become sexually  deviant when they mature into adolescence or adulthood. It is commonly  known that sexual molestation is something that ripples down until  something puts a stop to it, like incarceration, so until someone stop  the behavior, a child who has been molested themselves is more likely to  act out sexually when they get older (Levenson & Grady, 2016). If a  child is sexually abused and comes from a home that is neglectful, they  are less likely to get the help they need to heal from the sexual  trauma, which could also put them at risk for sexual deviance at at a  later age, so this is another fact that plays into the psychological  side of explaining sexual deviance.

Final

 Due in 1 Hour

For the final exam, you will be analyzing three different hypothetical cases. Please answer the questions for each case in complete sentences, with proper spelling, grammar and punctuation. Each answer should be at least 3-4 paragraphs in length, and contain reasons for your answers. Please provide citations to cases if you feel it is necessary to fully answer the question.

Case One

A police officer who works near a local airport observes a car speeding on the road leading into the airport. He stops the car and approaches the vehicle, where he sees a man alone in the driver’s seat and his suitcase in the back seat. The traveler is sweating profusely, and keeps telling the officer he is in a hurry to catch a flight. The officer asks the traveler if he can search his luggage, and the man says yes. When the officer unzips the bag and starts the search, the man changes his mind and says no. At that point, the officer leaves the bag unzipped but still laying on the back seat where the contents are not visible. He calls for another officer to bring a drug detection dog to the site. The other officer and the dog get called to a more urgent search and don’t appear. The traveler asks to leave, which the officer says is ok, but he won’t let him take his bag. The traveler refuses to catch his plane, and asks for an attorney.

Analyze this case from both the traveler’s and the police officer’s perspective. What constitutional rights are at issue? Have any of them been violated?

Case Two

A police officer observes a motor home driving erratically down a main street at 10:00 a.m. She is concerned that the driver may be impaired by alcohol or drugs. When the officer approaches the driver’s side of the vehicle, the window is down and she can smell a strong marijuana odor. She also observes two other people in the vehicle, a woman in the front seat and a man in the middle of the mobile home sitting at a table. She also observes a clear plastic bag on the table with a white powdery substance inside. What can the officer do next based on these facts? Be specific in your answer.

Case Three

The Patriot Act, as originally passed and amended, significantly increased the ability of law enforcement to use search and surveillance procedures in the investigation of activities in the United States in the interest of national security and preventing terrorism. One provision of the Act, Section 213, is known as the “sneak and peek” provision. The provision provides law enforcement with warrants to enter a suspect’s house, and look for records on their personal computers, without notifying the suspect a search has occurred. This provision has also been used to investigate crimes other than terrorism, such as drug and fraud cases. Evaluate the pros and cons of this law, and include in your analysis the constitutional provisions that are affected.

What do you feel is the best way to handle gangs and other special populations in the juvenile justice system? Specifically identify three of the most important factors in determining whether a youth will join a gang and which of the issues identified as special populations most prominently shapes or alters the processing of offending juveniles. Defend your position with some facts and data.

I feel that the best way to handle gangs and related special populations should start with a two-pronged approach. The first would be a cooperative effort between school, law enforcement and other social or youth related services to provide stronger outreach and prevention methods through education, awareness and youth activity programs. I would argue the second step would be proactive gang enforcement. This could be done by using police and probation resources to provide for an intensive supervision program that would allow for gang monitoring and intelligence information. I would argue though controversial, a unit like the LAPD’s CRASH Unit of the 1990’s would be a good idea. The overall concept worked and reduced crime before the corruption scandals. As it pertains to the 3 factors that would shape the juvenile offenders to join gangs is first, it provides a sense of belonging to a group, in some cases acts as families for the gang (Taylor, Fritsch, 2011).  The second is that it provides for a way for a youth to obtain money through drugs and other crime, the last reason is that friends join gangs and they want to belong (Taylor, Fritsch, 2011).

In your opinion, what should be the five most important characteristics of a functional long-term juvenile detention facility? Explain why you believe these are the most important.

Is it necessary that the environment be like a prison to meet the stated goals of the juvenile justice system? Why, or why not?

                                       CLASSMATE’S POST

As it pertains to a long term juvenile correctional facility, I would argue that these 5 items are needed to ensure success and functionality of the facility. The first thing that is needed for a successful long-term facility is security.  If the facility is not secure, then escapes can occur and if a juvenile is not in secure custody correctional treatment cannot begin. The next step is that it must have competent staff, this is staff who has been background checked and trained in correctional law and use of force. This ensures that security functions properly and that those who harm children are not employed and that up to date training is provided. The next step is a successful treatment team, this will ensure that programs and treatment is available for issues related to criminal or delinquent activity such as substance abuse and mental health. The next area needed is education to ensure that the juvenile can still learn and have a chance to develop knowledge and skills that can be used after release from detention. The final item is medical care, this will reduce cost from outside medical trips resulting in reduced transport cost and staff safety issues. In addition, this provides earlier intervention for illness or injury treatment in opposed to waiting for outside intervention. I would argue that these services need to be set up in a prison style fashion to ensure secure custody and control of the juvenile. If a juvenile need to be in a detention setting, they are a risk to the public or there self and a risk of escape needs to be mitigated which can be done with secure custody.

Sexual  violence is a crime that happens far too often and to many women and  men. Approximately 1 in 4 women and 1 in 6 men have been sexually abused  and out of those statistics only 28% of the victims report the crime  (The Center for Family Justice, n.d.). The truth is inevitable, rape is a  vert common crime, but what makes someone want to sexually abuse or  rape a person? There are different theories that are believed, as to why  someone would be sexually deviant, some believe it is biological while  others believe it is psychological. Biological theorists believe that  the acts of sexual deviance are because someone is born with them and  psychological theorists believe that outside factors such as, trauma,  what is learned through social interaction and development. Biological  theorists believe there is an impulse that causes someone to be sexual  deviant and also believe that a man who is susceptible to be sexually  abusive may also have the capabilities to produce a larger number of  children, but there other biological theorists that believe that it is  more of a want, the want to achieve a certain number of sexual partners  (The Advocates for Human Rights, 2006). There are various perspectives  that focus on the psychological aspect of rape and sexual abuse.  Researchers will often look into the offender’s past life to determine  what made offender decide to commit such an act.

`When  it comes to the explanation on sexual deviance and whether the act is a  result of biological or psychological, there is not one perspective  that is right. Each and everyone of our thought processes are different  because we are different, so a sexual offender and their choice to be  sexually deviant can have a multitude of variables that affect their  decision, but I do not believe someone is born to commit such sexually  deviant acts and that some kind of trauma or it’s something an offender  has learned because they have viewed such an act and were essentially  taught that the act itself if normal. There a many variables that can  affect someone’s choice to commit a crime such as rape or sexual abuse  and oftentimes it takes great research to determine the why of such  awful situations.

REPLY TO CLASSMATE’S DISCUSSION

There have been a number of different approaches used to handle problematic students in schools. One direction is to main-stream the problem children in hopes that by surrounding them with pro-social peers, they will see what is acceptable and unacceptable behavior and conform.  Another approach is to isolate them in special schools designed to handle discipline issues while concentrating the problem children into a single location.

Start your post with a declaration of which of these two options is better and explain why.

                                        CLASSMATE’S POST

As it pertains to problem students, I would make the argument that they should remain with peers in a pro social environment.  I can recall in 2002 when I was a sophomore in college I worked as a school district police officer part time for about two and a half years. I was able to deal with and see up close the role that peer, and pro social behavior played in positive development of troubled kids. The approach in the district I worked was to keep kids in the school, they would get suspended and a criminal summons for fighting but still stayed in regular school. If a student became too violent or became too much of a discipline issue, they were sent to an intermediate unit school.  While I did not work at this type of school, I knew officers that did and dealt with some of the students. This type of school was filled with students that relied on bad and criminal behavior and I feel was a training ground for juvenile detention or jail later in life. I feel that in regular school even if I filed criminal charges against a juvenile, I could still see them and keep an eye of them and be a positive role model along with teachers and friends. The alternative form of education did not offer this approach which is why I feel it would have more of a negative impact.

How Citizens Engage in Community-Oriented Policing?

 100% Plagiarism Free

Community policing should be a citizen owned effort. Of course the police and other city agencies should be involved when necessary but the most consistent and comprehensive effort should belong to the neighborhoods and businesses that are in the affected area.

Assume that you are a community leader in an area with no ongoing community-oriented policing effort. For this week’s assignment you are to evaluate the role of citizens in the community-oriented policing effort. How would a group of citizens assess the needs of the community and critically analyze what resources they have and need to make a positive impact? What would be the best strategy be for your group to engage with the police and other city agencies in this effort? The Stanford prison experiment had every intention of being just an experiment. However, as the time had progressed each had started taking on their assigned role and it had gone from an experiment to an actual prison within the matter of a couple days. The guards had started to change after the first couple of days from looking at this as an experiment and treating it as a prison. The prisoners had started to riot very quickly because of the action of the guards and the situation had quickly gotten out of control. What the experiment was supposed to achieve is how people would react when put into that environment. What the experiment had achieved was that guards would instantly take control of the situation and take into their own hands how to break the prisoners so that they would follow orders and punishment was used rather harshly. What the experiment had uncovered was that the person would revert to a state of shyness to at which try and keep dignity, the guards most likely use the extreme measures as a first resort which was seen in the experiment.

The one thing that can be taken away from this project and be applied to prisons is that make sure guards are aware that they should only have to use the extreme on prisoners who do fight back and make their job hard. The reason why I would recommend this is because the actions at which the guards take causes the prisoner to revert to the shyness so that they can protect their dignity. After watching the video, I am surprised to see that the guards in only a couple days had started to lose sight of the true purpose of the experiment and at which had turned the experiment into a full functioning prison.

In the video Quiet Rage: The Stanford Prison Experiment, the main goal was to test the psychological and behavioral consequences of becoming a prisoner and a prison guard. A group, consisting of 24 people was selected to play the roles of inmates as well as officers. This experiment was set to last for two weeks of observation.  But, it came to an end in less than one week. Things got out of control and what was set to be an experiment became a real-life prison scene. There were officers abusing their power causing inmates to rebel. Some inmates stuck together even though officers considered them ” well behaved”, they refused their privilege until all inmates were going to receive the same treatment.

My recommendation would be for the inmates to respect the officers and for the officers to not mistreat the inmates. Both parties play a role in what takes place in prison. There is no need for innocent inmates to be receiving push-ups, or having their beds taken away because one of their peers are violating. Working in this field, one thing that I’ve learned is that when your fair and firm, things operate a lot easier with less resistance from the inmates.

RESPONSE MICHAEL

A potential problem that might exist with the development of the Department of Homeland Security (DHS) is the notion many of the departments, which fall under the umbrella of the organization, are territorial in that they adhere to an “us against them” mentality.  According to Stojkovic, Klinich, Klofas, 2015, management of such critical organization as DHS demands that each element be coordinated, integrated, and utilized to effectively and efficiently achieve organizational objectives. If state and local law enforcement agencies fail to share information and resources at every opportunity, the DHS fails to reach its potential to thwart minor as well as major threats to the nation. Organizations such as the Federal Bureau of Investigations (FBI), Drug Enforcement Administration (DEA), and Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) must avoid fragmentation at every opportunity.

Local and state budgeting requests within the Criminal Justice System like in most organizations follows a bottom up approach to demands for resources, (Stojkovic, Klinich, Klofas, 2015).    Not withstanding this historic responsibility, the allocation of resources from top to bottom perspective likely falls on the Department of Homeland Security.  Furthermore, the responsibility of maintaining security of the United States is a daunting task and creates an enormous imposition on government budgeting as well.  As the DHS prioritizes resources throughout it’s different constitutes, more than likely it has to reduce requested funding for some agencies in order to have its own appropriate funding.  The development of the DHS has definitely required there be procedural changes regarding resource distribution throughout the state and local agencies. Furthermore, this new agency must work diligently towards facilitating multi-directional communication within the framework of the criminal justice system.

The due process model emphasizes the individual rights of the accused at all stages of the justice process (Masters, Skrapec, muscat, Dussich, Way, Hooper, Gerstenfeld, 2017). The question of how the organization can balance due process while simultaneously protecting the nation is likely a concern for DHS.   One would expect this to be an extraordinarily complex challenge for the Department of Homeland Security when considering the enormous responsibility the organization has protecting the entire nation from international and domestic terrorism.  A byproduct of America’s war on terrorism is the enemy combatants who engage in nefarious activity throughout the nation focusing on destroying democracy in the United States.

Many Americans continue to have dreadful thoughts of the tragic September 11 events, which changed their lives forever. The plot to disrupt the way of life in the United States by destroying the World Trade Center was then, and continues to be attributed to Osama Bin Laden.  The May 2, 2011 assassination of Bin Laden in revenge for his involvement in these events provoked his followers to retaliate against the United States potentially. According to Gollwitzer, Kitka, Wisneski Sjostrom, Liberman, Nazir, Bushman, 2014, this type retaliation is vicarious and may fuel a desire to take even more revenge.  Some believe this is what we see and here with anti-Muslim rhetoric.  In my opinion, having Bin Laden imprisoned may have prevented the image of him as a martyr. Furthermore, a lifelong imprisonment at the conclusion of a trial may have better shown the world the efficiency and fairness of our judicial system.

In light of the creation of the Department of Homeland Security and the fight against terrorism the due process questions include whether or not  terrorist should stand trial or should they be killed? Does the United States have to provide criminal defense services to the accused?  Should American citizens recieved the same harsh treatment upon arrest for terrorism as foreign nationals?

The due process protections matter in the fight against terrorism in my opinion because our criminal justice system calls for fair treatment for the accused. The U.S Supreme Court ruling in Cooper V. Pate gave prisoners access to the courts by granting them the right to bring civil actions against prison authorities for violations of civil rights.  Furthermore, in 1974, in Wolf V. McDonnell, the Supreme Court applied Fourteenth Amendment procedural rights to prison inmates, guaranteeing them not only access to the courts but also due process in disciplinary hearings.  Clearly due process protections matter in the fight against terrorism.
