In the fall of 2001, following the deadly attacks on the World Trade Center, the United States experienced the first cases of anthrax it had seen since 1978. The sources of the anthrax spores were letters sent to the American Media, Inc. building in Florida, Tom Brokaw of NBC News, Dan Rather of CBS News, and Senators Edward Kennedy, Tom Daschle, and Patrick Leady in the United States Senate. There were a series of deaths, cutaneous infections and hundreds of employees at these organizations who tested positive for exposure to the anthrax spores. As a result of these exposures, the most effective antibiotic for treating anthrax, Cipro, was in high demand. Bayer A.G., a German company, owns the patent for this antibiotic and a significant ramp-up in production was needed to meet the increasing demand for those who had been exposed to anthrax. Bayer A.G.s United States unit went into 24-hour shifts following the anthrax breakouts. Mr. Brokaw held up a bottle of Cipro on his program, NBC Nightly News, and calmed a jittery public by saying, In Cipro we trust. Workers at one of Bayers U.S. plants cheered with the coverage.

However, executives at headquarters for the company remained silent for weeks about the companys ability to manufacture sufficient amounts of the patented antibiotic. Executives indicated that the company was concerned that if it appeared in the media it would give the appearance of taking advantage of the dire circumstances. Bayers history made it wary of any involvement in international battles. Bayer A.G. had to pay reparations following World War II and its patent for its world-famous aspirin, Bayer, was stripped from it and awarded to a U.S. company. It was not until 2000 that Bayer was once again permitted to use its name. The companys low profile during the anthrax scares was deliberate and explained by executives as a desire to avoid appearing exploitive of the problem of the infections and illnesses.

Frustrated with the lack of communication from Bayer, Canada suspended Bayers patent in Canada and ordered other drug manufacturers to begin production of their pending generic formulas for Cipro. Other drug companies do have their own formulas developed and ready to go, but could not produce these generics so long as Bayer held its patent protection. One company, Apotex, indicated its production method would not infringe on Bayers patent, but Bayer threatened litigation and indicated it would deliver all the Cipro needed and/or ordered by both the United States and Canadian governments. Health officials were skeptical and one stated, Theres no way you can tell me getting it from six companies is going to be slower than getting it from one company.

Professor John W. Dienhart, a business ethics professor at Seattle University, stated that Bayer should be a good corporate citizen. He added, This is not breaking a patent but adjusting a patent to meet a particular need.

The U.S. Congress was considering suspension of the Cipro patent in the U.S. in order to ramp-up production even more. The legislation would permit federal judges to suspend patents on the basis of public health issues.

In response to some panic in the United States, pharmacies in Mexico, permitted to sell Cipro without a doctors prescription, as required in the United States, were ordering large amounts of Cipro, increasing their prices and doing a great deal of profitable business from U.S. orders. For example, the Zipp Pharmacy, located in Ciudad Juarez, a border town, says its orders for Cipro increased 15 times what they were before the 2001 anthrax infections. A nurse buying doses of Cipro for her entire family said, What if there were mad runs on it? Its nice to have it around just in case.

Physicians at the Center for Disease Control (CDC) were concerned about the Mexico purchases and use of the drug without physician prescription. They note the following problems: (1) some people are allergic to Cipro and can become quite ill with just one dose; (2) Cipro has side effects for almost everyone including nausea, vomiting, and loss of appetite; (3) Cipro does have an effect on the brain including possible seizures and hallucinations or simple mood changes and insomnia; and (4) Cipro damages cartilage in the joints, especially when taken by children and is given to children only when there is the absolute need (i.e., there is an infection ongoing). The CDC has advised use of Cipro only upon determination of exposure or infection from anthrax.

Bayer continues to struggle with its position, promises, and public perception as the anthrax infections creased. Bayers corporate policy is as follows:

We offer our customers a wide variety of products and services in areas ranging from health care and agriculture to plastics and specialty chemicals. Bayer is research-based and is aiming for technological leadership in its core activities.

Our goals are to steadily increase corporate value and generate a high value added for the benefit of our stockholders, our employees and the community in every country in which we operate. We believe that our technical and commercial expertise involves responsibility to work for the common good and contribute to sustainable development.

Bayer: Success through Expertise with Responsibility.

What decisions do you think Bayer should make in this situation? Should it suspend its patent voluntarily? What recommendations should it make on taking Cipro? Should it back the warning from the CDC? Is it wrong for Bayer to profit from this public health problem? Develop a memo that offers ethical guidelines for a Bayer executive.

According to our textbook the Electoral College, which is made up of electors from each state. Each state is allocated equal to the whole number of Senators and Representatives to which the State may be entitled in the Congress (Levin-Waldman, 2012). Basically this is saying that the amount of representatives from each state is based upon the state’s population.  Florida for instance gained 2 electoral votes because its population is increasing (Flagler County Supervisor of Elections, 2016). There are a total of 538 electoral votes and a candidate needs to win majority of the votes to win. That number is 270.

One pro for this system is that a lot of Americans do not follow politics or simply do not or cannot vote. This system was designed so that representatives were chosen due to their wisdom and knowledge of politics, not due to their preference for any particular candidate.

A con for this system is that most Americans feel like their vote does not count. That is why a lot of people I know and work with do not vote.

What I would change without formally abolishing this system is that we get rid of the representatives and then just vote using the popular vote. The popular vote would then win the candidate the amount of electoral votes for that state. That way every American will have their voice heard.

reponse two

During a presidential election, the Electoral College determines the President. The Electoral College is comprised of 538 votes from the states and the number of votes a state has is determined by the number of Senators and Representatives combined in that state. Each party assigns electors that pledge their vote to that party’s candidate. Once the popular vote is tallied, and a candidate is selected for that state, the winning members of the Electoral College have their vote counted and the state is awarded to the candidate (Levin-Waldman, 2012).

Some will argue that the Electoral College is not a democratic manner in which to choose the President while others maintain full confidence in the current means to elect the President. In states whose votes are not proportionate to their population, the numbers are inflated. A vote in a high population state will inevitably count less than a less populous state with the minimum number of Electoral College votes. In addition to the disproportionate populous votes versus EC votes, the issue of swing states arise. For instance, if a state such as California is expected to vote in a specific manner and there is a state with a large number of EC votes without a determined candidate, the candidates will spend more time in the undetermined state while alienating the determined state’s voters. Finally, presidents sometimes fall into a situation where they win the EC vote, but face a House with a majority members that belong to the opposing party (Bates, 2004).

Historically, Republicans have supported the EC because of a desire to maintain states rights and an adherence to the foundation laid by the founding fathers. Conversely, Democrats have supported either amending the Constitution to abolish the EC or even going as far as to supporting a state level legislation that awards EC votes to the winner of the national popular vote (Gizzi, 2011). The latter proposal would effectively remove the power of the states to determine the president.

I can see the points made by those that support the EC in that the states hold the power in electing the president. As a Constitutional supporter, I also understand that the Constitution was created in such a manner that would allow changes to be made if the situation arose. I feel that in all fairness, the president and any elected representative should be elected based on popular vote. The power of the people in electing their leaders should prevail, not the choice few.

A big part of  life my life is under the executive and judicial branch has a very big influence on my life. The one of the biggest things would be raising the minimum wage to $15 an hour once that is done that creates a Snowball Effect.  First it’s $15 an hour the workers and then the number 1 Value Meal instead of being by $5.50 it becomes $9.

Then once that is done now McDonald’s will have to increase their food items. The National Restaurant Association says a $15 base would force employers to replace workers with technology, such as touch-screen ordering tablets. It says about 90% of restaurants are small businesses that lack deep pockets. “Fifteen dollars is too far, too fast,” spokeswoman Christin Fernandez says.

And wants McDonald’s employees receive $15 I can see Wal-Mart employees doing the exact same thing. You can see that this is not going to end well for Wal-Mart. They are wanting the exact same thing then the snowball, becomes an avalanche and with the Wal-Mart employees expecting $15 an hour. You will have all of the truckers that are driving all these routes instead of the normal $0.25 to $.35 cents per mile. The driver would expect $0.50 per mile from Wal-Mart. The big oil can see their diesel price going up instead of being as of right now right around $2 per gallon. The oil companies could see that they would need to cash in on that, so now it would go to $4.50 per gallon. Each person will take their little bit peace and they are trying to bridge the gap between the lower-income and the middle-class income.  The only way they can change that is by changing their job. where it is more of a skill and not a label intense job like as in a fast food restaurant. In that same breath we will have all the people that are skilled trades and that are working in factories. They would also like a raise too!! throughout the nation to expect more.  You cannot increase the wage of the people without having repercussions that would be catastrophic throughout the nation.   As long as we can stay the course and if it needs to be raised to $8 or $9 that can be justified, but going up to $15 would start an avalanche Across the Nation and the Chain Reaction. That would not be a good site it can put it back into that bubble that we had in 2007 with the housing market and people are just now starting to make a comeback from that. California is the first state to give worker $15 now we will see what happen in the next few years. How this is going to run in the state or is it a boom in the making.

The Servicemember’s Civil Relief Act of 2003 replaced the Soldiers’ and Sailors’ Civil Relief Act of 1940 and expanded upon the latter legislation. President George W. Bush, signed the new law in December 2003 to reflect the changes in life since the 40’s. This law allows servicemembers to break certain lease agreements and halt certain judicial proceedings while serving their country in specific instances (SCRA, 2003). This law affected my personal life in many instances. I was afforded the opportunity to terminate my cellular phone contracts while deployed without affecting my credit worthiness. I was also afforded the opportunity to break multiple lease agreements when receiving orders to a new duty station without penalty from the lease holder. I have also been allowed to lower interest rates on many of my debts to 6% due to this law.

Many of the provisions of SRCA also benefited my wife once she left active duty in 2006. As my spouse, the provisions provided in SRCA were passed to my wife as my spouse which greatly affected our ability to pay off our debt before I left active duty in 2013. We both benefited from the provision that our state of residence remained the same as when we entered the military, allowing us to pay less of a tax penalty when filing taxes out of state (Save and Invest, 2016).

Weekly tasks or assignments (Individual or Group Projects) will be due by Monday and late submissions will be assigned a late penalty in accordance with the late penalty policy found in the syllabus. NOTE: All submission posting times are based on midnight Central Time.

You are the emergency manager in a medium-sized city, and your city manager has directed you to provide a 2-hour lecture to a combined meeting of the Citizen’s Police Academy and the Citizen’s Fire Academy. Your task is to outline and explain the roles and responsibilities of the various entities or organizations that would respond to an emergency or disaster in your city, emphasizing the scalable nature of response efforts.

Assignment Guidelines

  • In this assignment, you will create an organizational chart that outlines the roles and responsibilities of those who would respond to a large chemical spill in your city.
  • You should presume that local, state, and federal personnel and resources will be involved in the response.
    • Be sure to highlight what organization should take the lead in the response.
  • Your chart should not only list each organization but should also provide brief descriptions (50–100 words) of the organization’s responsibility.
    • For example, the local fire department’s response would include the following:
      • Determine the identity of the materials involved.
      • Determine the type and severity of hazards present.
      • Assess the threat to human health and environment.
      • Assess the need for evacuations, site control, security, and notifications.
      • Direct interim remedial procedures to limit the spread of the materials.
  • You may create the chart using any software application of your choice. You may also draw the chart by hand and upload the scanned image if necessary.
  • All sources must be referenced using APA style.

POL201: American National Government

The formal process of amending the Constitution is cumbersome and slow.  While this fact explains why relatively few amendments have been adopted, it does not discourage advocates of constitutional change from proposing them. Four amendment proposals that have gained considerable attention are the Balanced Budget Amendment, the Birthright Citizenship Amendment, the Equal Rights Amendment, and the Overturn Citizens United Amendment. Select one of these proposals as the topic of your initial post and use the assigned resources to inform yourself about its purpose and the arguments of its supporters and critics.

Before writing your initial post, review the assigned resources. To easily access the resources from the Ashford University Library, please see the table located in the Course Materials section.

In your initial post of at least 200-250 words, briefly summarize what the proposed amendment would do and the problem its proponents say it will solve. Explain the main pros and cons in the debate about the amendment. Evaluate the proposed amendment from two perspectives:

  • Your own political philosophy, values or ideology. (Justify your assessment by clearly explaining your political values and why they lead you to support or oppose the amendment.)
  • The likelihood that the proposed amendment will eventually be ratified to become part of the Constitution. (Justify your assessment by explaining how the proposal will or will not, in your judgment, survive the ratification process.)

Fully respond to all parts of the question. Write in your own words. Support your position with APA citations to two or more of the assigned resources required for this discussion. Please be sure that you demonstrate understanding of these resources, integrate them into your argument, and cite them properly.

Assignment 4: Marketing of the Acquisition by EDUS

In this assignment, you will research information related to the marketing and promotion of the acquisition by EDUS and provide an assessment. Click here to review the EDUS case and consider the following:

Topics for Research and Analysis

Promotional Goals: Identify specific objectives related to the promotion of EDUS’s acquisition of the institution. In addition, identify specific objectives related to informing potential students of new capabilities and offerings resulting from the acquisition. (Promotional goals vary. Some organizations need to create awareness of their product’s benefits compared to competitors. Other promotional goals may involve communicating new uses for an item, or informing customers or lower prices.)

Business Environment: Identify cultural and legal factors that might influence promotional decisions – both in announcing the acquisition within the region and recruiting new students to the institution. (In some countries, certain information is required in television commercials selling products aimed at children.)

Media Plan: Analyze media availability to determine cost-efficient methods of communicating with potential students within the country and within the geographic region. (While television, radio, newspapers, magazines, and the Internet may be common in industrialized countries, developing economies may require other different media. In some countries, advertising messages are broadcast through large speakers mounted on moving trucks.)

Promotional Strategy: Compare the benefits of push-and-pull promotions for acquiring new students at the institution. Devise a promotional strategy that will help EDUS expand the student body and also inform potential students of increased capability of the institution resulting from this acquisition.

Economic, Cultural, and Political-Legal Environment: Investigate the economic, cultural, and political-legal environment that might affect promotional messages and media relevant to this acquisition.

Recommended Actions: Recommend EDUS actions related to promotional goals, needed adaptations due to cultural or legal factors, and a media plan. Provide evidence to support your recommendations.

Conclusions:Draw conclusions about the material you have presented. The opinions or judgments you present should be supported by your research.

submit a PowerPoint presentation (approximately 10 slides) providing your analysis and research findings on the topics indicated. You are expected to include statistical data when possible, including tables, graphs, and other visuals that support and enhance your study. Most importantly, all written assignments and responses should follow APA rules for attributing sources! Submit your document to the M4: Assignment 4 Dropbox.

EDUS’s Acquisition of MCU

The Situation:

The CEO of EducUS Corporation (EDUS), in conjunction with the EDUS board of directors, has decided to increase the corporation’s footprint and expand its international operations. After identifying global opportunities, the EDUS board of directors decided to explore the possibility of purchasing the Mekong Cham University (MCU) located in downtown Phnom Penh, Cambodia. This university is a small academic institution which has a strong technology school but is short on resources. Specifically, the Mekong Cham faculty members are highly acclaimed technologists who are widely published in the field of information technology and enterprise software application. However, while MCU enjoys an exceptional local reputation as an educational institution, it has difficulty in recruiting students outside the Southeast Asia region. One reason is that MCU has no capability, due to lack of funding, to provide online course offerings. Another reason for the low enrollment at MCU is the poor physical condition of the university building complex. EDUS Corporation also enjoys an excellent reputation as the third largest provider of nontraditional education in the U.S. EDUS is the parent company of 26 universities located throughout the U.S. and Canada. It has a strong international business and management program offering in most of its holdings and is known for its exceptional online delivery capability.

You have been selected to work on the EDUS research team in support of the steering committee for this acquisition. You are part of a high performance work team which will focus its research in 5 separate areas. The EDUS CEO has briefed the team and expressed the need for comprehensive research to ensure that the acquisition of MCU will be right for both organizations. She tells you and the team that acquisitions, like this, are often unsuccessful because of incompatible cultures, clashes in management styles, poor integration strategies, and inadequate communications. So she has requested that you particularly focus on these areas of inquiry. The EDUS CEO also informs you and the team that although she understands that this project will take some time, it is imperative that preliminary recommendations be presented within the next eight weeks. To meet the guidance of your CEO, you will lead the project team in a presentation of the team’s findings within this designated period.

THIS IS THE ESSAY

ESSAY

Barrack Obama. There are mixed reactions to the relationship of the current US President Obama and the foreign countries. There are countries that think that he is a good leader while others feel that he is not good enough. People have been very keen on his relationship with other countries. Barrack Obama has been a critic of the leadership of some countries. America chooses hope rather than fear. Being a superpower, America is supposed to oversee the activities of other nations. This has beenreceived with mixed reactions.

Poland and China are not happy with the president of the United States. Russia and China want a different currency to be used instead of Using the Us Dollar. The president of the United States cannot accept this. Thus Russia and China have becomeenemies” of the United States. The President of Iran does not like the president of the United States. He once called him a puppy. Many countries have shown opposition to the US president (Sharma, D and Uwe, P., 2013). Nations like South Korea have launched more missiles since Obama took the office. Countries like Iran are making nuclear bombs too.

The activities of the United States of the war in Afghanistan, Iraq and Pakistan has triggered more enemies to the president from the Arab countries. He had promised that he will bring the troops out of these nations, but he has not done that. Targeting Middle East on a fight against terrorism has not beenreceived well. He has beencriticized for championing for war in the name of bringing peace.

Many people feel that it is not the best way. Whenhetooktheoffice, manypeoplesaw President Obama as thebestbutthey currently believethathe has failedand over timehe has receivedcriticisms from foreigncountries on themannerhehandlesforeignaffairsissues. To many, he is a contrast of the Obama they thought of in 2008.

There has been tension and gridlock in the dealings between the United States President Obama and the Congress since Republicans took control of the house back in 2010. Issues such as weak job growth and immigration have not been dealt with well. In February 2014, the relationship between the Congress and the White House reached a little (Hendrickson, R., 2015). Thiswas after the speaker of the house said that it will be hard for the House to move on the reform of immigration this year. He showed distrust in President Obama in the implementation of a new law of immigration. 2013 became the least productive year for the Congress since the Second World War. It involved impasse between the president and the lawmakers. It partially led to the shutdown of the federal government for about 16 days.

The relationship between the Congress and the White House may get even more polarized. This is if in thisfall’s midterm elections the Senate will be taken by the GOP. It need only a net gain of only six seats. However, experts believe that the relationship can still be solved or even improved.

There have been criticisms of the manner in which the Congress is doing things in Washington. Thisled to the Republicans at one time hold meetings to plan to sabotage the President Obama tenure. The Congress was voted the worst in the history of the US. However, the Congress has shown some efforts in trying to push some bills (McConnell, M., 2015). The legislators are now pushing had to ensure that they achieve their legislative objectives. However, the differences between the Congress and the White House has been a set back on the activities of the Congress and the White House.

Discussion—Poverty and Discrimination

Assignment 1: Discussion—Poverty and Discrimination

Poverty and discrimination are linked as one often leads to the other and vice versa. The poor are a target for discrimination due to their circumstances, while discrimination due to ethnicity, race, or gender reduces the number of economic opportunities an individual might get. In this module, you explore the segments of the population that are more likely to be poor. You also examine the reasons for the poverty of these segments and its implications for social policy development.

Research the link between poverty and discrimination using your textbook, the Argosy University online library resources, and the Internet.

  • Select two journal articles that address the linkage between poverty and discrimination reflected in the conditions of racial and ethnic minority populations.
    • Be sure to select one article that addresses poverty and discrimination in the United States and one in any other country.
    • Make sure the articles include examples of social policies that have attempted to address these issues.

Respond to the following:

  • How is the linkage between poverty and discrimination reflected in the conditions of racial and ethnic minority populations?
  • Identify two examples of social policies that have attempted to address these issues and discuss their effectiveness.
  • Support your positions with material from your library research.

Write your initial response in a minimum of 200–300 words. Apply APA standards to citation of sources.

By Saturday, January 26, 2013, post your response to the appropriate Discussion Area. Through Wednesday, January 30, 2013, review and comment on at least two peers’ responses. Cover the following items in your posts:

  • Provide a statement of clarification.
  • Provide a point of view with rationale.
  • Challenge a point of discussion, or draw a relationship between one or more points of the discussion.

MUST BE ORIGINAL WORK, NO PLAGIARISM

Case Study 3: Confessions and Admissions after a Request for a Lawyer
Due Week 8 and worth 100 points

A suspect is apprehended in a large-chain grocery store by the security guard. The suspect is placed in handcuffs and taken to the manager’s office. The police are called and advised of the situation. Officer Jones arrives at the store approximately 12 minutes later. Officer Jones takes a statement from the security guard and views the in-store camera film of the shop lifting incident. Officer Jones places the suspect under arrest, reads the suspect the Miranda warnings, and asks the suspect if he would like to make a statement. The suspect replies, “No, I would like a lawyer”. The suspect is then transported to the local jail and booked. Five (5) hours later, the suspect is interviewed by a detective who again reads him the Miranda warning. The detective then asks the suspect if he would like to talk. The suspect says, “Yes”. He eventually confesses to the crime.

Write a two (2) page paper in which you:

  1. Identify and discuss the constitutional amendments that would relate to this situation.
  2. Discuss how the Edwards Rule is related to this situation.
  3. In your opinion, determine if the suspect’s confession to the detective is admissible.
  4. Use at least two (2) quality references. Note: Wikipedia and other Websites do not qualify as academic resources

Your assignment must follow these formatting requirements:
