Week 4 Discussion 1 POL 201

Prepare: Prior to beginning work on this discussion, read chapters 8, 9, and 10 in American Government and watch the video, Episode II – It’s a Free Country.

Reflect: Our political system is characterized by certain fundamental features to include a system of laws, rights, and liberties. The laws, created and supported by the Constitutional framework, are designed to protect and secure the rights and liberties of individuals and groups throughout the U.S. However, the government also has an obligation to provide for the security of its citizens from serious internal and external threats that could cause grave or severe damage to our country. The need for homeland and national security can create a dilemma where conflicts emerge between these security needs and the demands for civil rights and liberties.

Write: In your initial post, explain what obligations the U.S. government has towards its citizens and how can these obligations impact individual and group rights? Provide real-world examples to support your explanation. Fully respond to all parts of the prompt and write your response in your own words. Your initial response must be 200 to 250 words. Support your position with APA citations to two or more of the assigned resources required for this discussion. Please be sure that you demonstrate understanding of these resources, integrate them into your argument, and cite them properly.

My major is Health and Wellness, and I am in the Military. Please have discussion reflect this.

Almost all people have times in their life when they feel that they are not in control of the events that happen to them. There are often times when others seem to have more power over people than they do over themselves. This can create a strong feeling of power imbalance between oneself and another person. Sometimes, this can be because of a positive power imbalance, in the case of a mentor, advisor, or supervisor who uses his or her authority to guide and teach others. Sometimes, however, this can also be because of a negative power imbalance, in the case of a boss who bullies; a boyfriend or a girlfriend who can be emotionally and physically threatening; or in the case of a confrontation, one person initiating violence against another.

In the United States and in other countries around the world, power imbalances are often commonly experienced by populations who may be political or social minorities because of their gender, race, tribal and ethnic association, or socioeconomic status. Consequently, discrimination may occur as a way of preserving the status quo as a means of preventing others from accessing multiple public and private services, credit, employment, and housing opportunities, for example.

As people bring the personal into the professional, self-awareness is important for homeland security personnel when working and intervening successfully with critical incidents that may involve culturally diverse responders, survivors, and perpetrators. Coping with unpredictable and ongoing situations of crisis and terror can arouse personal feelings of helplessness and lack of control. It is important, therefore, to understand what particular coping strengths you can bring into such a situation, your ability to respond to and manage such a situation, and what your capacity is to learn from such events for future use.

Therefore, looking back over your own life, choose a situation in which you experienced a major power imbalance while interacting with another person that either assisted or prevented you from meeting your aims. This could be, for example, with a former boss, coach, teacher, parent, or friend who had some kind of authority over you when the incident occurred.

Assignment Guidelines

  • This paper should be between 750–1,000 words and will be written in 3 parts:
    • The first part should be labeled “Part 1: What Happened.”
      • Insert as much objective detail as you can remember, in as factual a manner as possible.
    • The second part should be labeled “Part 2: Looking Back.”
      • Insert what you felt your response was to what happened during the event.
    • The third part should contain discussion regarding 2 additional aspects and should be labeled “Part 3: What I Learned and How I Can Apply It.”
      • Write about the lessons that you learned from this experience.
        • Consider your future career as a homeland security or emergency management professional.
        • Consider what advice you would offer if a friend, relative, or fellow professional had faced a similar situation to what you faced.
  • When choosing an event, pick an occurrence that you feel has been resolved to a great degree in your mind.
  • It is not the purpose of this assignment for you to re-experience a feeling of trauma and feel upset; rather, you should be able to choose an incident that you feel that you have learned and gained wisdom from.

Task  Detail

CJUS261-1501B-01 Ethics in Criminal Justice
Task Name: Phase 5 Individual Project
Deliverable Length: 1,250-1,500 words
Details:

Weekly tasks or assignments (Individual or Group Projects) will be due by Monday and late submissions will be assigned a late penalty in accordance with the late penalty policy found in the syllabus. NOTE: All submission posting times are based on midnight Central Time.

You and your partner are detectives working in plain clothes. For several days, you have been staking out an elementary school playground where an adult male reportedly has been approaching the children. One particular morning, you have observed a man in his car parked alongside the school yard. When he calls a little girl over to his car and she approaches him on the driver’s side, you exit from your unmarked vehicle and approach his vehicle from the passenger side so that he cannot see you easily in his rear view mirror. When you get just behind his car on the passenger side, you observe that he has his pants open. With his left hand, he is stroking the girl’s hair.

You call for your partner over the radio and move to arrest the suspect. Showing him your badge, you order him to close his pants and get out of his car. You handcuff him and place him in the back of your unmarked vehicle, while your partner returns the girl to the safekeeping of school administrators.

After telling the suspect of his right to remain silent, you begin interrogating him, recording his name, address, and so forth while awaiting your partner’s return.

When your partner comes back, he gets in the rear of your vehicle with the suspect (a violation of department regulations, unless there is reason to believe that the passenger is suicidal). You remind your partner that riding in the back is a violation of the rules, but he stays there anyway; tells you to drive to the station; and turning to the suspect, calls him a “maggot.” As you drive, your partner starts punching the suspect repeatedly in the face and the crotch. He even leans back and, bracing himself against the car door, kicks the suspect in the chest and shoulders with the heel of his shoe. When the suspect turns to avoid the blows, your partner kicks him in the back and kidney areas. Throughout this beating, the suspect offers no resistance of any kind. You hear the sounds of the beating and, looking in the rear view mirror, you see your partner striking the suspect. After about a minute, you pull the vehicle over, open the rear door and persuade your partner to get out of the back seat and come sit beside you in the front.

After the suspect is booked and in a holding cell, your partner tells you he will write a report that includes the assertion that the child molester forcefully resisted arrest and sustained injuries during the scuffle to handcuff him. He tells you that he will write the report and sign it, and that you do not have to be associated with its contents.

At his trial, the offender pleads guilty to child molestation charges and is sentenced to 3 years in prison, to be served at a treatment center for sexual offenders. Soon afterwards, your partner is sued by the offender for physical abuse and injury. Claiming kidney damage, loss of two teeth, civil rights violations, and psychological trauma, the convicted molester is asking a civil (not a criminal) court for an award of $2 million from your department and $500,000 from your partner. You receive a subpoena from the court to appear at the trial. In addition, the Internal Affairs Division will launch its own investigation of the allegations, and it informs you that you will be called in to make a statement under oath at a hearing about the events. If the department finds sufficient grounds to believe that your partner acted brutally, he will be suspended, or more likely, fired; if the civil jury finds that he was abusive, he may be forced to sell his home and car to pay the award to the victim. You may also be disciplined for failure to protect your prisoner. Comments in the locker room by other officers make it clear that, given the nature of the victim, they expect you to do whatever is necessary to protect your partner from being held accountable, as well as to protect yourself.

Should People Be Able To Vote Online?

  • Write a 2 to 3 page, APA style paper, explaining why you believe people should or should not be allowed to vote (either local or national elections) using the Internet.
  • In your paper include a discussion of the opposing position along with your rebuttal (of that opposing position).
  • For instance, if you decided to write a paper explaining that people should be allowed to vote using the internet (and why)–then your rebuttal would be that people should not be allowed to vote using the internet (and why).
  • Note:  Explaining means to give details about something: to give an account of something with enough clarity and detail to be understood by somebody else.
  • Include a title page and 3-5 references.  Only one of your references may be found online (not Wikipedia).  The other references must be found in the Grantham University online library. Please see the rubric below.

Midterm Exam

Unlike talk show hosts or political bloggers, students in college are asked to exercise “critical thinking,” which means they must clearly and objectively see both sides of an issue in order to effectively argue a position.
Today we often hear of the populist position that size of government must be reduced. Yet we never hear from anyone arguing that government should be larger. For this examination, write an essay of no less than 600 words meeting standard APA requirements, making a case for larger government. Use at least three sources from EBSCO to support your position.
(Hint #1: Think about the problems our nation’s leaders experienced with the Articles of Confederation.)
(Hint #2: Consider the powers shared by the federal government and states.)

Bureaucracy

Is the bureaucracy as powerful as the other three branches of our government?
  • Note: a bureaucracy is an administrative system, especially in a government, that divides work into specific categories carried out by special departments of nonelected officials.
  • Write a 2 to 3 page, APA style paper, explaining why you think it is or is not possible for the “Fourth Branch” of our government (the bureaucracy) to be equal with the other three branches.
  • Include the opposing position along with your rebuttal of that opposing position.
  • For example, if you believe that the “Fourth Branch of the US government should be equal to the other three branches (and why), your rebuttal would be to people that do not believe the “Fourth Branch” of the US government should be equal to the other three branches (and why).
  • Include a title page and 3-5 references.  Only one of your references may be found online (not Wikipedia).  The other references must be found in the Grantham University online library. Please see the rubric below.

American National Government

In a recent lecture at Yale University, Supreme Court Justice Stephen Breyer cautioned that while most citizens assume that judicial review is an enduring part of American government, judges should not take it for granted. He advises that if judges wish to preserve this undemocratic power they should follow a judicial philosophy that will “build confidence in the courts” (Breyer, 2011). Justice Breyer goes on to describe the kind of judicial philosophy he has in mind. However, some of his colleagues on the Supreme Court would reject his ideas about what philosophy should guide judges.

The role of judicial philosophy (or ideology) in Supreme Court decision-making, especially in its exercise of judicial review to invalidate laws enacted by a democratically elected Congress or state legislature, has become a highly contentious issue both within the Court’s deliberations and in the larger political environment. As the nation becomes more divided over programs and policies that inevitably seem to come before the Supreme Court, politicians and ordinary citizens are caught up in rhetoric about judicial activism or judicial restraint, often with little understanding of what these terms really mean.

Moreover, as public perceptions of the Supreme Court become more politicized, the legitimacy of its power becomes clouded. If the Court is perceived as just another political institution making political decisions, but a completely undemocratic institution because its judges are appointed and serve for life, questions arise about whether the Court’s power of judicial review should be strictly limited or eliminated altogether. Justice Breyer’s warning comes to mind as the percent of Americans approving of how the Supreme Court does its job slid from 61% in 2009 to 46% in 2011 (Gallup, 2012).

Before writing your initial post, review the assigned resources. To easily access the resources from the Ashford University Library, please see the table located in the Course Materials section.

In your initial post of at least 200-250 words, respond to one of these questions:

  • What judicial philosophy should guide the Supreme Court’s exercise of judicial review?
  • Should the Supreme Court’s power of judicial review be strictly limited by a constitutional amendment?

In answering either question, clearly state your position (thesis) at the beginning of your post. Define important terms and explain your position fully. Consider pro and con arguments on both sides of your position and respond to the con arguments. Justify your position with facts and persuasive reasoning.

Fully respond to all parts of the question. Write in your own words. Support your position with APA citations to two or more of the required resources required

Before writing your initial post, review the assigned resources. To easily access the resources from the Ashford University Library, please see the table located in the Course Materials section.

The purpose of this forum is for you to share and discuss with classmates your understanding of some of the academic literature about this subject in order to help you write the Final Paper in the course. Your initial post will have two parts. Fully respond to both parts of the question, and write in your own words.

  • In 150 to 200 words, summarize, in your own words, one of the academic articles required for this discussion (from Section 5 of the assigned resources). Select an article from the list that you think may be a source for your final essay. Read it carefully and try to understand the author’s main points that may be relevant to your final essay. First, give the full APA citation for the article. Then, summarize the relevant main points and explain the author’s reasoning as you understand it. At the end of your summary, ask one question about a specific point in the article that you do not understand and would like some help with (refer to a page number).
  • In 50 to 75 words, state what you believe the thesis of your Final Paper will be. State the thesis as clearly and fully as you can. Draw upon what you have learned from all the required resources you reviewed for this discussion. While you can change your mind about your thesis when you actually write the Final Paper, use this discussion forum as a serious opportunity to try out a thesis and receive feedback from your peers.

Juvenile Justice – Putting it in Perspective

In Chapter 1 of the text, our author talks about “putting it all into perspective.” After reading chapters 1 and 2 and reviewing the video Young Kids, Hard Time (this video is recommended, but not required), select one of the juveniles from your reading, the movie, or you may speak from personal experience and a particular juvenile in mind. Address the three questions in the following quote from the video:

https://www.youtube.com/watch?v=g3lw6PMjj40

“In a world that demands justice when the unthinkable becomes reality, there are no easy answers when that reality involves minors. The United States has the highest incarceration rate in the world and remains the only nation that, in rare circumstances, will sentence its juveniles to life without parole. Is it a solution? Does it work? Do we care?”

Your initial post should be at least 250 words in length. Support your claims with examples from the required material(s) and/or other scholarly resources, and properly cite any references. Respond to at least two of your classmates’ posts by Day 7 and continue to support your arguments with examples from the required material(s) and/or other scholarly resources. Review your classmate’s opinions in light of your understanding of the juvenile justice system.  In your response posts, support one of the positions below:

  1. Depending on the serious nature of the crime, juveniles should be tried in an adult court and be subject to adult punishments.
  2. Juveniles should not be punished with sentencing in adult prisons.
  3. Juveniles deserve a second chance. They should not be tried as adults or serve time in adult prisons.
  4. Sentencing juveniles to adult prisons is like saying society has given up and there is no treatment that can affect their adult potential. It is the responsibility of society to treat juveniles and that treatment should be administered in juvenile facilities.

POL 201: American National Government

Week 5 discussion Question 2

Voting and Turnout

The U.S. has one of the lowest voter turnout rates among modern democratic political systems. One study ranks the U.S. 120th on a list of 169 nations compared on voter turnout (Pintor, Gratschew, & Sullivan, 2002). While during the last decade many initiatives have been undertaken to increase voter participation, concerns about the possibility of election fraud have also increased. Additionally, some political interests feel threatened by the increase in turnout among some traditionally low-turnout ethnic minorities.

Several states have recently passed legislation imposing new registration and identification requirements. This has sparked debate about whether these are tactics intended to suppress turnout or to prevent fraud.

In your initial post of at least 200-250 words, summarize recent developments in several states enacting voter ID laws. Explain the pros and cons on both sides of the debate about these laws. Share your own experience with the relative difficulty or ease of voting in your locale. Draw your own conclusion about the debate over voter ID laws. Finally, share your perspective about whether voting in the U.S. should be made easier or harder. Justify your conclusions with facts and persuasive reasoning.

Fully respond to all parts of the question. Write in your own words. Support your position with APA citations totwo or more different resources required for this discussion. By Day 7, respond to at least two of your classmates’ initial posts. Your peer responses each must be at least 75 words. They must demonstrate critical thinking (e.g., ask a relevant question about your peer’s post while explaining why your question is significant, or state a perspective that contrasts with your peer’s while explaining or justifying your position).
