Utilitarianism vs. Human Rights-Based Policing

Scenario:

Officer D. Tainer works for the University Police Department.  While working the midnight shift, the dispatcher asked Officer D. Tainer to respond to a domestic violence call. Upon arrival, the victim, Margarie Blackmon, ran out of her house up to Officer D. Tainer’s patrol car.  Margarie appeared to dishevel (crying and shaking) holding her cell phone.   

Margarie took a couple of deep breaths and then said, “My husband, Carl Blackmon, punched me in the face which knocked me down, and while I was lying on the floor, he put his hands around my throat, which made it difficult to breathe.  As Carl was strangling me our son children Michael who is 4-years-old, woke up because of the noise and saw what his father was doing and started hitting Carl yelling at him to stop hurting his mommy.” 

Officer D. Tainer asked Margarie if Carl was still in the house.

“No,” replied Margarie, “that is what I am trying to tell you; Carl took Michael and left the house in his black pickup truck before you arrived.  I received a text after he left, and that is why I called the police.”

Officer D. Tainer said, “Let me see the text.”  Margarie turned her phone around so Officer D. Tainer could read the text from Carl, which said, “I cannot take this anymore, I am going to end my life and our sons because I know he means more to you than anything else in the world.  I am going to kill Michael because this is the only way I can hurt you as you have hurt me, and if I cannot have you, no one will.”

Margarie said, “I did not hurt him; I just asked for a divorce because I found out he had been cheating on me.”

Officer D. Tainer asked Margarie, “Does Carl have any weapons like a gun or knife with him that you know of?”

“Yes, he has a gun; I do not know what kind, but he has a conceal and carry license,” replied Margarie.

Officer D. Tainer, notified dispatch of the information he obtained and requested a BOLO, which is to be on the lookout for Carl Blackmon and his son Michael Blackmon.  Officers were to arrest on site, and the suspect may be armed and dangerous.

Within minutes, an officer arrested Carl, who was walking down a side street by the University City Lake; Michael was not with Carl.

At the station, Carl refused to tell the officers where Michael was, and said, “You might as well lock me up because when you find him, it will be too late.  It is all Margarie’s fault if she had not asked for a divorce; I would not have had to do what I have done.”

”What have you done Carl?” Asked Officer D. Tainer. Officer D. Tainer tried to convince Carl to tell him where Michael was, but Carl remained silent. Officer D. Tainer contacted the detectives on duty, Al Catchem and J. Walker, and filled them in on the particulars of the case.

Detectives Catchem and Walker met Officer D. Tainer in the interrogation room and before questioning Carl, Detective Catchem said, “Officer D. Tainer we have it from here.  I would appreciate it if you would wait outside in the hall and do not let anyone in this room until I tell you to?” 

Officer D. Tainer hesitated for a minute and then said, “Yes.”  Officer D. Tainer stepped outside the interrogation room, and Detective Walker shut the door behind him.  

Officer D. Tainer did not know what was going on in the interrogation room, but there was a lot of commotion that sounded like furniture being turned over, and then there was some grunting, crying, and yelling. After a few minutes, there was no further noise coming from the room, and then Detective Walker opened the door.  Officer D. Tainer thought Detective Walker appeared disheveled; he was leaning on the doorframe taking deep breaths, he had his shirtsleeves rolled up, and the knuckles on his right hand were bloody. 

Officer D. Tainer asked, “Detective Walker, are you alright?”

Detective Walker said, “Oh, this,” and looked down at his shirt and knuckles.  “I tripped over the chair and scuffed my knuckles on the wall as I was falling; I am ok.”

Detective Catchem interjected and said, “We know where Michael is, send every unit to the University City Lake.  Get the rescue divers out there too; maybe there is still time to save him.  Carl tied Michael to the seat of the truck with duct tape and rolled the truck into the lake, hoping to drown him.”

The Emergency Medical Technicians (EMTs) who responded to the lake notified Detective Catchem that Michael was located in the cab of the truck, and was not hurt.  A log at the bottom of the lake prevented the truck tires from rolling any further into the water.  Michael is fine and is in the ambulance waiting for Margarie to arrive and pick him up.

Assignment:

          It always amazes me when I see a chart like this one. It is hard to believe that we live in one of the most dangerous country’s in the world. I have traveled to at least 75% of the states in our country and it seems the only times that I may be concerned for my safety are in certain big cities. High crime areas. 

          Looking at the data that was given to us we see that the United States is by far the biggest in population, second biggest when it comes to land mass, and one of the highest practicing countries of a religion. We also have one of the greatest amount of different ethnic backgrounds in the world. When you put all these together with the guns in the mix you are going to have some problems. Not that guns are a bad thing. I believe we need them in the hands of law abiding citizens. But when you have such a vast difference in income class levels and the amount of money that our country has, you’re going to see problems arise. When people struggle to live with little food, bad health situations, and a low income, that most of the time does not even provide for their families, they will turn to crime. 

            When it comes to our Gross Domestic Product per capita (GDP) and guns per 100 residents it makes a whole lot of sense why we are an outlier as the sixth most dangerous country in the world. With there being such a difference in income levels it usually leads to crime with the use of a gun. It has to do with our freedom, which of course is not a bad thing. I believe this is a huge reason for the number of guns that our country possesses. We have more access and freedom to buy guns then any other country in the world. Just about anyone can get a firearm in the United States legally or illegally. When that is the case people will arm themselves for protection. The average home in the United States that possess guns legally, probably ranges from 3-5 in each home. 

              Our country needs to spend more time educating individuals of how important guns are, if used and handled properly by the right people, we would probably see a decrease in deaths. As long as we continue to grow in numbers and income so will our crime. We just need to be prepared with better trained law enforcement and making citizens aware of their rights. 

Criminal Law Emily

 

 Michelle and Stacey were roommates. Michelle had a boyfriend named Steve. Stacey did not like Steve very much. She found him to be ignorant and thought he drank too much. Stacey also did not like the way Steve treated Michelle. One night Stacey game back to the apartment and found Steve stabbing Michelle in her chest over and over yelling, “how could you do this to me Michelle, I love you with all my heart, how could you.” Steve was visibly drunk. Stacey walked over to her desk drawer and pulled out a gun and stated, “I have had enough of you Steve.” Stacey shot Steve straight in the heart and he died. Moments later Michelle got to her feet and took the knife Steve was stabbing her with and stabbed Stacey in the chest several times yelling, “I loved him, how dare you.”

Discuss the crime(s) Stacey and Michelle would be guilty of using the model penal code.

Stacey and Michelle are both caught in this odd scenario where they respond emotionally to the events that are occurring. Stacey found a good justification to finally get rid of Steve who she already strongly disliked however Michelle responded in a fit of passion. In Stacey’s scenario she had enough time to walk over where she new a weapon was and make the decision to shoot Steve and have the intent of killing him. Michelle’s response isn’t so calculated its more a knee jerk response.

The two differences are important. The Model Penal Code has two classifications intentional and unintentional. There are subcategories to these which are purposefully, knowingly, recklessly and negligently. The first two belong with the intentional category and the last two belong with the unintentional. Stacey had intent to kill Steve and she purposefully and knowingly did it. Michelle on the other hand was reckless and negligent in her response. [1]

Since the Model Penal Code was created some states have decided to expand on it, for example Oregon. Oregon expanded on voluntary manslaughter and the defense heat of passion is now used often. In this instance I could easily see the heat of passion defense being used in this case to protect Michelle who had not only just been stabbed by her boyfriend but then seen him shot. I believe in this instance both would be charged with voluntary manslaughter but one would have a stronger defense than the other. [2]

Rob Banks graduated from the police academy and is now a rookie officer who is starting his six months of training with Field Training Officer, Justin Case. Officer Case is supervising Officer Banks during the 4 p.m. to midnight shift.  At 11:00 p.m., Officer Banks and Officer Case are dispatched to a burglary in progress at the University City Ball Park concession stand. Jane Chatman was walking her dog near the ballpark when she heard a loud crash near the concession stand.  Chatman walked toward the concession stand to investigate the noise.  As Chatman neared the concession stand, she saw three teenage boys ransacking the place.  Chatman quietly walked away from the concession stand and called the police department to report the burglary. When Officer Banks and Officer Case arrive at the ballpark, the perpetrators had already fled. Officer Banks said, “The concession stand is a mess it appears the perpetrators have stolen numerous items, where do we start?” Officer Case replied, “Officer Banks, first, I want you to contact the police dispatcher and have them get in touch with the director of the ballpark and ask the director to respond to the concession stand.  We need the director to tell us what is missing and the value of the items for our report.” Chatman saw the officers arrive at the ballpark and walked over to the concession stand and said, “Hi, my name is Jane Chatman and I am the one who called the police department to report the burglary.” Officer Case thanked Chatman for reporting the crime, and told Officer Banks, “Go ahead and get Chatman’s information and see if she will write a statement as to what she saw.  Remember to ask her to give you a description of the juveniles she saw.” While Officer Banks was writing down Chatman’s information for the police report, he saw Officer Case picked up a piece of double-bubble gum off the counter in the concession stand.  Officer Case then removed the gum from the wrapper, tossed the wrapper on the floor, put the gum in his mouth, and walked over to meet the director of the ballpark who just arrived at the scene. Perspectives of Social Disorganization

Cesare Bonesana, Marchese de Beccaria is known as the father of the the classical school of criminology/father of criminal justice and influenced and inspired what we know today as the American criminal justice system.  One of the most revolutionary ideas within the American Criminal Justice System is the concept of Due Process.

In this paper I will examine elements within the criminal justice system that are based on or are residual processes from Beccaria’s work, more specifically the concept of Due Process.

Social Disorganization

Social disorganization is a theory that was created by Shaw and Mckay that is used to explain the breakdown of social control that causes different levels of crime based on the factors shaping the relationships within and across neighborhood communities (Bernard, Snipes, Gerould, & Vold, 2016, p. 142,144).  

Factors of a Socially Disorganized Neighborhood

Kornhauser discussed the basic argument that within neighborhoods where people are poor, live in racially and ethnically diverse neighborhoods, frequently move from place to place will have difficulty assimilating and maintaining social relationships within the neighborhood (Bernard, Snipes, Gerould, & Vold, 2016, p.144). I think these factors plus distrust of the police, and single parent households contribute to the social disorganization of neighborhoods and communities. It seems that residents within those neighborhoods often disassociate themselves from the responsibility of camaraderie with the people who live around them and the overall responsibility of making sure the neighborhood or community achieves their common goals of social control.

Lack of Ability and Willingness for Social Control.

Triplett, Sun, and Gainey examined the ability and willingness of neighborhoods to enact social control, and it’s influence on crime rates (Triplett, R., Sun, I., & Gainey, R., 2005).

When I reviewed the article I observed that the researchers felt four factors influenced the willingness for neighborhoods to enact social control: neighborhood structural characteristics,  trust, environmental characteristics, and ability (Triplett, R., Sun, I., & Gainey, R., 2005).  The researchers looked at social ties, quality of police services, and cooperation with the police as a way to shape ability and willingness to enact social control and their effects on neighborhood crime rates (Triplett, R., Sun, I., & Gainey, R.,2005)

Personal Experience with Houston Neighborhoods

Upon reflecting on my days on patrol, I patrolled in two different districts/neighborhoods within the City of Houston.  The first neighborhood I patrolled was predominantly single dwelling residential homes and the second neighborhood I patrolled was a low income apartment home communities with some single dwelling residential homes.  While there were some distinct differences within the neighborhoods the interesting part was that I observed some similar criminal patterns within both neighborhoods, but it was the way members of the neighborhood handled.  Both areas were predominantly Black and Hispanic, one area was lower middle class with predominantly homeownership, and the other area was lower income with very little homeownership. 

I did observe from the area where majority of the residents were homeowners, there was more pride in the overall appearance of the neighborhood. The residents of that neighborhood were more willing to cooperate with and assist the police in order to stop criminal activity. There was an overall sense of accountability and a level of responsibility for the state of the neighborhood. In the neighborhood were there were more apartments and less homeownership the disassociation with the neighborhood was evident. There was a lack of desire to assist police in stopping crime, members of that neighborhood often turned an eye to the criminal activities and would not get involved with assisting police in solving crimes to stop the criminal activity. 

Overall I saw how not seeing something and saying something impacted the level of criminal activity within the community. I saw how more people within the neighborhood that had no real responsibility became victims of the crimes that they turned a blind eye to. It is an important function of the members of the neighborhood to police within their neighborhood, speak up when they observe the teenagers vandalizing the buildings, call police when they observe drug dealing on the corner, help to be the change that can transmogrify the neighborhood.

Social Disorganization and the Bible.

When examining the idea of Social Disorganization from a biblical standpoint and relating the concept to scripture I turned to Jeremiah 12:10 which states “Many shepherds have ruined my vineyard, They have trampled down My field; they have made my pleasant field a desolate wilderness. I feel this explains perfectly what transpires within a socially disorganized neighborhood.  I feel this scripture touches on my previous point of how when society provides inadequate shepherding (lack of involvement with protecting the neighborhood), it leads to the neighborhood becoming destroyed.

In  conclusion, social disorganization is a theory used to explain how lack of social control impacts and contributes to criminal activity within neighborhoods. Many factors contribute to creating the disorganization. It is important to note that members of neighborhoods need to participate within their communities in order to combat crime. This can be achieved by developing a connection and a sense of responsibility to protecting the neighborhood.

I personally have not been a victim of a crime, but I do know of a few individuals who were victims of crimes. It’s unfortunate, but those individuals were murdered. I can’t say what the cost was but I’m sure the family was not prepared for unexpected funeral expenses. I do believe there was some type of financial compensation for their loss through a state-run victim compensation program.

Ethics plays a very crucial role in determining the moral and logical decisions in criminal justice research. Ethics provides the moral guidelines for the justice system and ensures the right decisions are made to serve justice to the affected people while preserving the civil rights of the parties involved. Through ethics, the accused and the victims are served with a balanced application of justice and fairness. Furthermore, ethics ensure that everyone acts in compliance with the law. For example, ethics allows the judge to understand when one is remorseful to get a more lenient punishment or impose a severe sentence when the accused has a criminal record of repeating the same offenses. Learning to report illegal activity in the locality for the benefit of the people in the community is part of ethics.

              If a researcher is not ethical, they can be held accountable to the public. It also compromises the truth, avoidance of errors, and knowledge. This makes the research work irrelevant if the researcher cannot be rendered trustworthy. Additionally, a lack of ethics might cause the researcher to contradict patenting policies.

            The media is becoming more prominent in crime prevention today. The media also facilitates the participation of people, globalization of culture, and the creation of public order and safety, making it easier to address security issues. However, the media can share critical information that criminals use to further commit crimes. Sometimes the media can make a situation worse by competing to get information out first. This can be controlled by filtering what is shared on the media to reduce getting information to criminals encouraging the growth of criminal activities.

How Citizens Engage in Community-Oriented Policing?
